West Virginia Impaired Driving, Open Container, and Implied Consent Laws

Driving while impaired by alcohol, drugs, or controlled substances is illegal in West Virginia. 11-Hour Limit 

Drivers may drive a maximum of 11 hours after 10 consecutive hours off duty.

14-Hour Limit 

Drivers may NOT drive beyond the 14th consecutive hour after coming on duty, following 10 consecutive hours off duty.

60-Hour Limit 

Drivers may NOT drive after 60 hours on duty in seven consecutive days. A driver may restart a seven-day consecutive period after taking 34 or more consecutive hours off duty.

70-Hour Limit 

Drivers may NOT drive after 70 hours on duty in eight consecutive days. A driver may restart an eight-day consecutive period after taking 34 or more consecutive hours off duty.

30-Minute Driving Break 

Drivers SHOULD take a 30-minute break when they have driven for a period of eight cumulative hours without at least a 30-minute interruption.

When experiencing adverse driving conditions, drivers can extend the 11-hour maximum driving limit and 14-hour driving window by up to two hours.

Drivers who violate the above-mentioned restrictions are removed from the road. As part of the penalty, they cannot resume driving until they have fulfilled the off-duty requirement. They may face fines if they have received several tickets for the same offense. Truck drivers and trucking businesses that violate hours-of-service regulations may be held accountable for any injuries or deaths resulting from their negligence in a crash.
